Court: Paris Hilton can pursue Hallmark lawsuit
The celebrity and heiress Paris Hilton may pursue her lawsuit against Hallmark Cards over its use of her picture and catchphrase “That’s hot” on a greeting card, a federal appeals court ruled on Monday.
Hilton had contended that Hallmark violated her privacy and right of publicity by ripping off a scene from her reality TV show “The Simple Life” on a birthday card captioned “Paris’s First Day as a Waitress.”
A three-judge panel of the U.S. 9th Circuit Court of Appeals rejected Hallmark’s argument that its depiction of the Hilton Hotels heiress was protected speech as a matter of law.
It sent the case back to a lower court, which had turned aside Hilton’s claim of trademark infringement but rejected other Hallmark defenses.
Lincoln Bandlow, a lawyer at Lathrop & Gage LLP in Los Angeles representing Hallmark, said “the analysis of the First Amendment defense is incorrect. It will leave a lot of speakers subjected to meritless right of publicity claims.” Read the rest of this entry »

A French climber dubbed “Spiderman” for his ropeless ascents of some of the world’s highest skyscrapers finally scaled on Tuesday a Malaysian tower he had tried to ascend twice before, and was then arrested.
Alain Robert, 47, used the cover of pre-dawn darkness to avoid detection from security guards at the 88-storey Petronas Twin Towers, and reached the top floor in around an hour and 45 minutes.
“I did try twice to climb, and climbing to the top is one of my dreams. It’s a bit like a love story, not only about climbing the tallest building to make it official… but about completing something unfinished,” Robert told Reuters ahead of the climb. Read the rest of this entry »

Michael Jackson’s funeral began more than an hour behind schedule near Los Angeles on Thursday night, 70 days after the pop star died of a drug overdose.
Jackson’s family and friends drove to Forest Lawn cemetery in Glendale, California, in a procession of more than 30 limousines and cars, some waving to a crowd of hundreds of fans and onlookers.
A few minutes later, a hearse arrived, accompanied by four police officers on motorcycles.
The ceremony, which was supposed to begin at 7 p.m. PDT (0200 GMT on Friday), was expected to run for about an hour, said a spokesman for the Glendale Police Department. Read the rest of this entry »

Harry Potter’s star, Emma Watson, denies reports claiming that she got into Yale.
A statement on her official website says, “There have been several rumors spreading recently that Emma has accepted a place at Yale University after ‘telling her fans via her Twitter account’. We would like to inform you that Emma does not have a Twitter account and that these rumors are false.
“Emma is still trying to decide whether she wants to attend university in the U.K. or the U.S.A. and hasn’t accepted any placements at this time.”
